Reworked Questionnaire for new applications for customs approval

On Feb. 6, 2018, the General Directorate of Customs published a reworked version of the questionnaire for new applications for customs approval. There is now a standardized questionnaire for all new applications for customs approval. The customs authorities hope to simplify the process for customs. The reworking of the list of questions and surveys was necessary, to conform to the new regulations as set by the Union Customs Index.

Standardized Questionnaire with various sections

The new standardized questionnaire is made up of various sections. Only relevant sections of the questionnaire must be filled out depending on which approval is being requested. Similar to the case in which a reassessment must be made for existing approvals, the Customs Authorities has deemed the “criteria based audit approach” as the right path for new applications, which is why the questionnaire now plays a central role. The questionnaire is to be used as of February 15, 2018. Companies that have received the older version from Customs are permitted to continue using that version.

The new standardized questionnaire does not at this point require information regarding the personal tax ID of employees. Such information is required by Customs Authorities for the reassessment of customs approval. This procedure is currently not being enforced – the case is currently being assessed by the European Court of Justice – it is however possible that in the future Customs will require tax ID information of employees working on new applications. So it is of upmost importance to be watching the development and how the European Court of Justice and the Düsseldorf Financial Court decide on the case
